The article deals with the approach to understanding science and technology as well as natural and cultural practices developed by the American philosopher Karen Barad in the concept of agential realism. The peculiarity of her approach consists in referring as a starting point to quantum mechanics in its interpretation, which was proposed by Niels Bohr. Barad proposes a reinterpretation of Bohr's propositions through revealing their ontological content. In this regard, the article addresses the epistemological and ontological problems that quantum physics (...) has faced, such as the conditions for the possibility of an objective description of the world, the nature of measurement, and the relationship between language and the material world. Discussed is the shift that Barad argues is asserted in Bohr's philosophy-physics, which consists of quantum mechanics moving from the linguistic concepts in which the world of classical science was represented to what Barad calls material-discursive practices through which the world is articulated and explained. The possibilities of a different interpretation of Niels Bohr's philosophy-physics are considered. (shrink)

In 1912, Julian Huxley published his first book The Individual in the Animal Kingdom which he dedicated to the then world-famous French philosopher Henri Bergson. Historians have generally adopted one of two attitudes towards Huxley’s early encounter with Bergson. They either dismiss it entirely as unimportant or minimise it, deeming it a youthful indiscretion preceding Huxley’s full conversion to Fisherian Darwinism. Close biographical study and new archive materials demonstrate, however, that neither position is tenable. The Bergsonian elements in play in (...) Julian Huxley’s early works fed into his first ideas about progress in evolution and even his celebrated theories of bird courtship. Furthermore, the view that Huxley rejected Bergson in his later years needs to be revised. Although Huxley ended up claiming that Bergson’s theory of evolution had no explanatory power, he never repudiated the descriptive power of Bergson’s controversial notion of the élan vital. Even into the Modern Synthesis period, Huxley represented his own synthesis as drawing decisively on Bergson’s philosophy. (shrink)

The International Federation of Gynecology and Obstetrics (FIGO) Committee for the Ethical Aspects of Human Reproduction and Women9s Health advises against tubal occlusion (TO) performed at the time of caesarean section (CS/TO) or following a vaginal delivery (VD/TO) if this sterilisation has not been discussed with the woman in an earlier phase of her pregnancy. This advice is neither in accordance with existing medical custom nor evidence based. Particularly in less-resourced locations, adherence to it would deny much wanted one-off sterilisation (...) opportunities to hundreds of thousands of women, many of whom have no reliable contraceptive alternative. To be sure, a well-timed discussion in pregnancy about a potential peripartum TO is preferable and, if conducted as a matter of course (as the Committee appears to promote), would represent an enormous improvement on current practice. Earlier counselling has the advantage that it results in fewer women who regret having rejected the CS/TO or VD/TO option. However, there is no evidence that earlier counselling leads to a smaller proportion of regretted sterilisations. Consequently, where early TO counselling has been impossible, forgotten or deliberately omitted on pronatalist, traditional, financial, cultural or religious grounds, offering a perinatal sterilisation belatedly and in an unbiased, culturally sensitive manner is often verifiably better than not presenting that option at all, notably where high parity and uterine scars are particularly dangerous. Belated counselling, as will be demonstrated in this paper, saves many lives. The Committee9s blanket rejection of belated counselling on perinatal sterilisation is therefore unjustified. (shrink)

This paper explores the concept of potential through a Deleuzean lens and argues that what is commonly understood as potential is often confused with possibility. It moves through four parts: an introduction exploring the language and context in which potential is ordinarily used in order to uncover underlying presuppositions; the next section explores key concepts from Difference and Repetition- namely the Dogmatic Image of Thought, Virtuality and Actuality- to illuminate ways in which a more nuanced concept of potential might be (...) understood, arguing that it is a creative process, rather than a fixed characteristic. Next, it explores how improvisation is a way in which potential can be experienced, before finally considering how changes to education practice- specifically a move towards a more mechanised, digitally-orientated world- might be wholly irreconcilable with potential as a creative process of encountering, and risks a much more impoverished concept that is liable to concretion. This paper will explore the relevance of vulnerability to children’s rights. Broadly speaking legal debates over children can be broken down into two camps. First, those who emphasise the vulnerability of children. For them rights designed to protect children from abuse and promote their welfare are the most significant. Second, those who claim that children are far less vulnerable than is assumed and should be given many of the freedoms of adults. For them rights of autonomy and freedom should be (...) emphasised. This paper will argue that both camps make the error of starting with the norm of adulthood being a time of invulnerability and independence from which children are either distinguished or are closer to than is normally appreciated. Once it is recognised that adults share in children’s vulnerability, we can see that childhood vulnerability is not something which children should be enabled to escape from, nor is it something that is unique to children. Vulnerability and interdependence should form the basis of rights for both children and adults. There is, therefore, no reason why children and adults should not have the same rights. (shrink)

We are very grateful to Richard Ashcroft 1 and Andrew McGee 2 for their thoughtful and articulate criticisms of our views. 3 Ashcroft has disappointingly low aspirations for the law. Of course he is right to say that the law is not a ‘self-sufficient, integrated and self-interpreting system of doctrine’. The law is often philosophically incoherent and internally contradictory. But it does not follow from this that all areas of the law are philosophically unsatisfactory. And if that were true, the (...) response should not be Ashcroft’s contemptuous despair, but a determination to make it better. Ashcroft would say that such idealism is unrealistic in the light of the very nature of ‘the Law’: ‘...a complex assemblage of institutions, rules, accredited persons, practices and systems’. That isa radically ‘legal realist’ position and is plainly unsustainable. We can demonstrate its unsustainability while demonstrating both that he is wrong... (shrink)

In this essay we review a number of values and conflicts involved in human nutrition in order to clarify the sources of resistance to accepting a pump-fed patient on the part of nursing home nurses. The case illustrates the complexities of our feelings and values in the area of intrusion showing the need for continued reflection upon and revision of our intuitive reactions. The case also displays conflict resolution.

In order to maximize human performance, defence forces continue to explore, develop, and apply human performance enhancement (HPE) methods, ranging from pharmaceuticals to (bio)technological enhancement. This raises ethical, legal, and societal concerns and requires organizing a careful reflection and deliberation process, with relevant stakeholders. We discuss a range of ethical, legal, and societal aspects (ELSA), which people involved in the development and deployment of HPE can use for such reflection and deliberation. A realistic military scenario with proposed HPE application can (...) serve as a starting point for such an iterative and participatory process. Stakeholders can discuss this application, modify its features, and design appropriate processes around it – for instance, procedures for informed consent. We propose that organizing aspects into these three categories – ethical, legal, and societal – can help involve appropriate interlocutors at different moments: legal aspects with people in strategy or management roles, from the start of a project; ethical aspects with people in operations and medical roles, during development; and societal aspects with people in communication and personnel roles, during deployment. Notably, we developed and discussed this framework and the three aspects in close collaboration with personnel from the military. (shrink)

In this article, we discuss critically some of the key themes in Max Deutsch’s excellent book, The Myth of the Intuitive. We focus in particular on the shortcomings of his historical analysis – a missed opportunity by our lights, on the claim that philosophers present arguments in support of the judgments elicited by thought experiments, and on the claim that experimental philosophy is only relevant for the methodology of philosophy if thought experiments elicit intuitions.

At the dawn of the twentieth century, Henri Bergson (1859-1941) became the most famous philosopher on earth. Where prior thinkers sketched out a deterministic, predictable universe, he asserted the transformative power of individual consciousness and creativity. An international celebrity, he made headlines around the world debating luminaries like Bertrand Russell and Albert Einstein about free will and time. The vision of creative evolution and freedom he presented was so disruptive that the New York Times branded him "the most dangerous man (...) in the world." This book provides a clear, concise description of medical law; but it does more than that. It also provides an introduction to the ethical principles that can be used to challenge or support the law. It also provides a range of perspectives from which to analyse the law: feminist, religious and sociological perspectives are all used.

As our understanding of biological evolution continues to deepen, tension still surrounds the relationship between competition and cooperation in the evolution of the biosphere, with rival viewpoints often associated with the Red Queen and Black Queen hypotheses respectively. This essay seeks to reconcile these viewpoints by integrating observations of some general trends in biosphere evolution with concepts from game theory. It is here argued that biodiversity and ecological cooperation are intimately related, and that both tend to cyclically increase over biological (...) history; this is likely due to the greater relative stability of cooperation over competition as a means of long-term conflict resolution within ecosystems. By integrating this view of the biosphere with existing models such as Niche Game Theory, it may be argued that competition and cooperation in ecosystems coexist at equilibria which shift preferentially towards increasing cooperation over biological history. This potentially points to a state of “cooperative equilibrium” as a limit or endpoint in long-term biosphere evolution, such that Black Queen and Red Queen behavior dominate different phases in an evolutionary movement towards optimal cooperative stability in ecological networks. This concept, if accepted, may also bear implications for developing future mathematical models in evolutionary biology, as well as for resolving the perennial debate regarding the relative roles of conflict and harmony in nature. The law tends to think that there is no difficulty about identifying humans. When someone is born, her name is entered into a statutory register. She is ‘X’ in the eyes of the law. At some point, ‘X’ will die and her name will be recorded in another register. If anyone suggested that the second X was not the same as the first, the suggestion would be met with bewilderment. During X's lifetime, the civil law assumed that the X who (...) entered into a contract was the same person who breached it. The criminal law assumed that X, at the age of 80, was liable for criminal offences ‘she’ committed at the age of 18. This article argues against the case for regarding bodies and parts of bodies to be property. It claims that doing so assumes an individualistic conception of the body. It fails to acknowledge that our bodies are made up of non-human material; are unbounded; constantly changing and deeply interconnected with other bodies. It also argues that holding that our bodies are property does not recognise the fact that we have different attitudes towards different parts of our removed bodies and the contexts (...) of their removal. The appropriate legal reform should, therefore, be to produce a statute which can provide a balance between the competing personal, social and interpersonal interests in different body parts. This article reconstructs the forgotten friendship between Georges Bataille and the Russian émigré poet and philosopher Boris Poplavsky. Comparing their solar metaphysics, I focus on conceptions of friendship, sacrifice and depersonalisation. First, I retrace Bataille’s relationship to early Surrealis and Russian circles in interwar Paris, with a focus on his friendship with Irina Odoevtseva. I then offer a novel reading of Poplavsky’s poetry through the lens of Bataille’s philosophy, analysing a recurring motif that I call ‘dark solarity’. Uncovering a hidden (...) intertextual dialogue between Poplavsky and Bataille, I argue for Poplavsky’s lasting impact on Bataille’s anti-Icarian sun cult. Finally, my paper demonstrates how Poplavsky’s writings on solar sacrifice, excess and friendship left marks on Bataille’s vision of a solar community, embodied in the secret society Acéphale. The dialogue between Poplavsky and Bataille, I finally suggest, is a missing piece in the entangled history of Russian and French philosophy, as well as an original contribution to discourses on friendship in twentieth-century continental thought. The theme of the Other remains relevant for both researchers and ordinary people. In the current world of information, characterized by increased social variability, the dynamics of becoming different (which is present in the life of any social subject) is regarded by author as an additional argument in favor of an empathic approach to the Other. Comprehension of one's own internal searches and various social relations is inscribed in the multi-layered social dynamics determined by various actors and their conceptualization (including (...) ideological) of what is happening in the running time. The correlation of the problem of the Other with the theme of change in time is fruitful both ethically, psychologically, and politically, because it is consistent with the request for social integration both within certain groups and on a global scale. The grounds for integration largely determine its character. The shift in the public focus of evaluation, criticism (up to prohibition) from the social actor to his/her specific actions is justified by the democratic tendency in operating with the principle of social exclusion. Campbell examines existing legal guidelines for adolescent decision making, arguing that greater space exists for clinical discretion in these matters than commonly thought. Cheryl D. Lew discusses the development of (...) agency in adolescent patients, the ideal of autonomous decision making in the context of impairment and chronic illness, and the obligation of healthcare teams to examine an adolescent patient’s decisions in relation to her identity. In a recent article, J. Angelo Corlett criticises what he takes to be the ‘offensiphobic’ practices characteristic of many universities. The ‘offensiphobe’, according to Corlett, believes that offensive speech ought to be censured precisely because it offends. We argue that there are three serious problems with Corlett’s discussion. First, his criticism of ‘offensiphobia’ misrepresents the kinds of censorship practiced by universities; many universities may in some way censure speech which they regard as offensive, but this is seldom if ever a (...) manifestation of ‘offensiphobia’. Second, we attempt to reconstruct Corlett’s criticism of ‘offensiphobia’ as a criticism of the practice of censuring hate speech, and show that this argument is unsuccessful. Third, we offer some brief reflections on how labelling universities as ‘offensiphobic’ is especially problematic in light of the current climate of political interference in university research and teaching. “Eve Sedgwick’s ‘Other Materials’” refers to a graduate seminar that Sedgwick offered at the CUNY Graduate Center entitled “How to Do Things with Words and Other Materials.” As its title suggests, her seminar advanced Sedgwick’s enduring “FASCINATION” with “MAKING UNSPEAKING OBJECTS” of all sorts, which elsewhere included the body’s organic and inorganic waste. Taking a cue from her teaching, I suggest that, while critics have extensively detailed Sedgwick’s contributions to literary interpretation, sexuality, gender, affect, and performativity, we should also appreciate (...) her writings as theorizing queer material relations. This observation is pertinent given her rethinking of psychodynamic object relations theory alongside her creative writings on “THE WASTE PRODUCTS,” or the matter we ceaselessly produce. My argument thus anchors its claims in a close non-Kleinian reading of her poem “Bathroom Song,” which also offers an unforeseen take on paranoid and reparative idioms of psycho-material being. How waste matter facilitates this unanticipated insight is one of my essay’s – and Sedgwick’s – subsidiary concerns. (shrink)

Whenever embryo experimentation is discussed the question of whether it is preferable to use spare or specifically produced (‘research’) embryos for destructive embryo experimentation always enters the debate at some stage. This question is analysed, and it is suggested that the distinction is morally uninteresting, but rhetorically useful for both sides in the debate. It is further suggested that part of the force of this distinction is caused by the fact that it is parasitic on a real moral distinction based (...) on the degree to which the gametes used in the experiment are obtained by explicit or implicit coercion. Recently, a physician requested permission to include in the information packet about himself that he would not accept patients who smoke and would not continue the care of current patients who smoke. His poignant statement follows.

Motivation has been the subject of much research in the sport psychology literature, whereas athlete mental health has received limited attention. Motivational complexities in elite sport are somewhat reflected in the mental health literature, where there is evidence for both protective and risk factors for athletes. Notably, few studies have linked motivation to mental health. Therefore, the key objective of this study was to test four mental health outcomes in the motivational sequence posited by the Hierarchical Model of Intrinsic and (...) Extrinsic Motivation: motivational climate  basic psychological needs  motivation  mental health outcomes. Elite team-sport athletes (140 females, 75 males) completed seven psychometric inventories of motivation-related and mental health variables. Overall, the athletes reported positive motivational patterns, with autonomous motivation and task climate being more prevalent than their less adaptive counterparts. Elevated depressive symptoms and poor sleep quality affected nearly half of the cohort. Structural equation modelling supported pathways between motivational climate, basic needs, motivation, and mood, depressive symptoms, sleep quality, and trait anxiety. Specifically, a task climate was positively associated with the three basic psychological needs, and an ego climate was positively associated with competence. Autonomy and relatedness had positive and negative associations with autonomous and controlled forms of motivation, respectively. Controlled motivation regulations were positively associated with the four mental health outcomes. Integrated regulation had a negative association with anxiety, and intrinsic regulation had a positive association with depressive symptoms. These findings highlight the complexities of and interrelations between motivation and mental health among athletes, and support the importance of considering mental health as an outcome of motivation. This article is designed to focus on the provision of nursing care in general medical wards following the admission of persons who have attempted suicide or who have a previous history of attempting suicide. The authors explore, analyse and synthesize how nurses, as key players in the health care team, may begin by recognizing the uniqueness of the individual, and by cotravelling therapeutically with the person on part of his or her journey towards recovery and healing. Efforts are made to (...) demonstrate how nurses can influence the health gain of this group of people and their families. Professional attitudes and related ethical aspects, such as autonomy, respect for autonomy and paternalism, are also examined within the context of the nursing care of people who have attempted suicide. The need to enhance sensitive and caring communication skills for nurses who work with this group of people is tentatively considered. Some reasoning about why there may be difficulties in specific areas of communication such as empathy are contested and explored. (shrink)

Sticker use is an increasingly popular part of daily messaging activity. However, little is known regarding the types, functions, and outcomes of sticker use in authentic online communications. To investigate these phenomena, we analysed sticker use in five small mobile-messaging-facilitated discussion groups initiated by students for course projects in an Asian university. The students used four types of stickers, among which ‘animated picture without text’ was the most frequent. Sticker functions fell into two main categories: as a tone indicator with (...) scope over a textual message, and as a stand-alone illocutionary act. Based on interviews with seven participants, we found disparities between the sender’s intention and the receiver’s interpretation for 34.7% of the stickers, but these disparities did not adversely affect the communication. In March 2020, the Government produced a document entitled “Responding to COVID-19: The Ethical Framework for Adult Social Care”(‘The Ethical Framework’). In this article, we summarise the key features of the proposed ethical framework and subject it to critical analysis. We highlight three primary issues. First, the emphasis placed on autonomy as the primary ethical principle. We argue if ever there was a context in which autonomy should dominate the ethical analysis, this is not it. Second, we examine the interface (...) between ethics and law which is largely overlooked in the document. Finally, we explore the surprising lack of attention paid to the concept of responsibility and communal obligations within the framework. (shrink)

Context: In the literature of radical constructivism, the epistemology and ontology of religion has been rarely discussed. Problem: I investigate the impact of radical constructivism on some aspects of religion - in particular, on the conflict that is sometimes perceived to arise between religion and natural science, discussed in the context of religious belief. Method: It is argued that the epistemology of radical constructivism serves to distinguish between items of cognitive and non-cognitive knowledge. This makes it possible to discuss issues (...) of religious belief, which are non-cognitive, from a constructivist epistemic and ontological perspective. Results: I conclude that radical constructivism cannot be invoked to support or contradict any particular religious faith; the individual knower will construct her own ontology, as part of her store of non-cognitive knowledge, in interaction with her environment ; on the other hand, any knowledge of it must be constructed in the mind of the knower, and there is no way to identify any one construction as being objectively “right” or “true.” Hence the truth value of propositions of religious conviction cannot be argued in cognitive terms. Implications: It is argued that these results elevate the knower into a position of personal autonomy with respect to religious issues. One consequence of this is the emergence of a fundamental epistemic incompatibility between the worldviews of radical constructivism and religion of any kind. Another is that the old dichotomy between atheism and agnosticism disappears - or rather, becomes irrelevant. Constructivist content: The role played by radical constructivism in the approach to cognitive vs. non-cognitive knowledge is discussed, specifically as pertaining to issues of religion. The construction of knowledge is a strictly personal enterprise, and the use of constructed non-cognitive knowledge then forms a basis for the individual knower’s religious position. (shrink)

Knowledge is generally a good thing. People who know lots of bits of information are generally admired. Some of them win prizes in TV competitions. If you were offered the gift of having an entire encyclopedia wired into your brain, you would probably accept, without thinking. But we should be wary of assuming that all knowledge is good. Too much knowledge can inhibit rather than enable thought.

What could someone represent that would enable her to track, at least within limits, others' perceptions, knowledge states and beliefs including false beliefs? An obvious possibility is that she might represent these very attitudes as such. It is sometimes tacitly or explicitly assumed that this is the only possible answer. However, we argue that several recent discoveries in developmental, cognitive, and comparative psychology indicate the need for other, less obvious possibilities. Our aim is to meet this need by describing the (...) construction of a minimal theory of mind. Minimal theory of mind is rich enough to explain systematic success on tasks held to be acid tests for theory of mind cognition including many false belief tasks. Yet minimal theory of mind does not require representing propositional attitudes, or any other kind of representation, as such. Minimal theory of mind may be what enables those with limited cognitive resources or little conceptual sophistication, such as infants, chimpanzees, scrub-jays and human adults under load, to track others' perceptions, knowledge states and beliefs.
